1. scope and seller
These terms govern every purchase made through aysound.com. The seller is Ayhan Dogan, trading as aysound, Zwergstr. 1, 89407 Dillingen a.d. Donau, Germany, e-mail info@aysound.com (“we”, “us”); the remaining details are in the legal notice. They apply in the version in force at the time of your order. Your own general terms do not apply, even if we do not object to them.
These terms address consumers as well as businesses. A consumer is any natural person entering into the contract for purposes outside their trade, business or profession.
We sell worldwide. YER can be ordered from any country; the licence key and the download work everywhere. Whatever your own country charges on the purchase of digital goods, if anything, is a matter between you and your own tax office.
2. what is on offer
The eleven plugins of the aysound suite are given away free of charge. No purchase contract comes about for them; the only terms that apply are those of the suite licence agreement.
YER is the paid product on this site: a frequency-selective sidechain ducker, a VST3 plug-in for Windows 10/11, 64 bit, delivered as a download with a personal licence key and free to try for as long as you like: in that trial mode the effect steps aside for two seconds every 45 seconds — in real time and in your export alike — and saving your own presets is switched off. Entering the key removes both limits permanently.
3. how the contract comes about
The product pages on this site are an invitation to order, not a binding offer. By completing the payment form hosted by Stripe and confirming payment, you make a binding offer to buy the licence shown there.
The contract comes about when we accept your offer — in practice the moment we send the licence key to the e-mail address you gave, which is normally within a few minutes of successful payment. If we cannot accept your order, we refund the payment in full without delay.
4. prices and VAT
All prices are total prices in euros. There are no shipping costs and no further charges, because nothing is shipped.
No VAT is charged. We are a small business under § 19 of the German VAT Act (Umsatzsteuergesetz): no value added tax is calculated and none is shown — not on the payment page, not in these terms and not on your receipt. What you see is what you pay, from whichever country you order.
YER costs 35 €. There is no introductory price for YER and no later price change is planned: it has one price. No VAT is charged on it either.
5. payment
Payment is handled by Stripe Payments Europe, Ltd. on our behalf. Which payment methods are available — card, PayPal, Apple Pay, Google Pay, Klarna, SEPA direct debit, bank transfer and others — depends on your country and is shown to you in the payment form before you confirm. Card details are processed by Stripe and never reach us.
Payment is due immediately on conclusion of the contract. We do not offer payment on account or in instalments.
6. delivery
After successful payment you receive an e-mail from info@aysound.com containing your licence key and the download address. The key is entered once in the product you bought and is then stored on your own computer; there is no online activation and no recurring licence check.
YER additionally looks once a day, and only while its window is open, whether a newer version exists. That has nothing to do with your licence, sends nothing about you, and can be switched off in its settings menu.
If the e-mail does not arrive within an hour — check the spam folder first — write to info@aysound.com from the address you paid with, and we will send the key again.
7. right of withdrawal
Consumers have a right of withdrawal. It runs for the full fourteen days; we do not currently ask for the consent that would end it early. The details, and the model withdrawal form, are on the right of withdrawal page.
8. licence
What the purchase entitles you to do is set out in the YER licence agreement. In short: a perpetual, non-transferable licence for the computers you work on yourself, free updates within version 1.x, and everything you produce with it is entirely yours.
9. defects
The statutory rules on defects apply. Digital content has to match what these pages describe. If YER does not do what its product page says it does, tell us: we will fix it, or, if we cannot, you get your money back.
What is not a defect: the trial-mode dropout before a key is entered, the absence of a macOS, AAX or AU version, and incompatibility with a host or system we do not list on the product page.
10. liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory product liability law. For slight negligence we are liable only for breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place, and only up to the damage typically foreseeable for this kind of contract. Any further liability is excluded.
Keep backups of your projects. That is true of every plug-in, ours included.
11. contract language and record
The contract is concluded in the language in which you used the payment page. We store the order data and send you the contract details by e-mail; these terms can be saved or printed from this page at any time.
12. applicable law and final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in another EU country, this choice of law does not deprive you of the protection of the mandatory consumer rules of your own country.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
Should a provision of these terms be or become invalid, the rest remains in force.
