DRAFT — two things are still open for the owner. The seller's postal address in section 1 comes from the legal notice, which is not filled in yet; and the VAT status in section 4 has to be decided (VAT shown at the standard rate, or the small business rule of § 19 UStG). Neither may be guessed. Until both are settled, these terms are a draft.
1. scope and seller
These terms govern every purchase made through aysound.com. The seller is Ayhan Dogan, trading as aysound, with the address given in the legal notice (“we”, “us”). They apply in the version in force at the time of your order. Your own general terms do not apply, even if we do not object to them.
These terms address consumers as well as businesses. A consumer is any natural person entering into the contract for purposes outside their trade, business or profession.
2. what is on offer
The eleven plugins of the aysound suite are given away free of charge. No purchase contract comes about for them; the only terms that apply are those of the suite licence agreement.
POMPA is the one paid product: a volume shaper as a VST3 plug-in and a standalone application for Windows 10/11, 64 bit. There is no macOS version, no AAX and no AU. POMPA is delivered as a download together with a personal licence key; it is not shipped on any physical medium.
POMPA can be run without a key for as long as you like. In that trial mode the effect steps aside for two seconds every 45 seconds — in real time and in your export alike — and saving your own presets is switched off. The key removes both limits permanently.
3. how the contract comes about
The product pages on this site are an invitation to order, not a binding offer. By completing the payment form hosted by Stripe and confirming payment, you make a binding offer to buy the licence shown there.
The contract comes about when we accept your offer — in practice the moment we send the licence key to the e-mail address you gave, which is normally within a few minutes of successful payment. If we cannot accept your order, we refund the payment in full without delay.
4. prices and VAT
All prices are total prices in euros including statutory value added tax. There are no shipping costs and no further charges, because nothing is shipped.

The introductory price of POMPA is 19 €. The regular price after the introductory phase is 29 €. The price valid for your order is the one shown on the payment page at the moment you confirm it.
5. payment
Payment is handled by Stripe Payments Europe, Ltd. on our behalf. Which payment methods are available — card, Apple Pay, Google Pay, Klarna and others — depends on your country and is shown to you in the payment form before you confirm. Card details are processed by Stripe and never reach us.
Payment is due immediately on conclusion of the contract. We do not offer payment on account or in instalments.
6. delivery
After successful payment you receive an e-mail from info@aysound.com containing your licence key and the download address. The key is entered once in POMPA and is then stored on your own computer; there is no online activation and no periodic check.
If the e-mail does not arrive within an hour — check the spam folder first — write to info@aysound.com from the address you paid with, and we will send the key again.
7. right of withdrawal
Consumers have a right of withdrawal. It runs for the full fourteen days; we do not currently ask for the consent that would end it early. The details, and the model withdrawal form, are on the right of withdrawal page.
8. licence
What the purchase entitles you to do with POMPA is set out in the POMPA licence agreement. In short: a perpetual, non-transferable licence for the computers you work on yourself, free updates within version 1.x, and everything you produce with it is entirely yours.
9. defects
The statutory rules on defects apply. Digital content has to match what these pages describe. If POMPA does not do what the product page says it does, tell us: we will fix it, or, if we cannot, you get your money back.
What is not a defect: the trial-mode dropout before a key is entered, the absence of a macOS, AAX or AU version, and incompatibility with a host or system we do not list on the product page.
10. liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory product liability law. For slight negligence we are liable only for breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place, and only up to the damage typically foreseeable for this kind of contract. Any further liability is excluded.
Keep backups of your projects. That is true of every plug-in, ours included.
11. contract language and record
The contract is concluded in the language in which you used the payment page. We store the order data and send you the contract details by e-mail; these terms can be saved or printed from this page at any time.
12. applicable law and final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in another EU country, this choice of law does not deprive you of the protection of the mandatory consumer rules of your own country.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. The EU platform for online dispute resolution is at ec.europa.eu/consumers/odr.
Should a provision of these terms be or become invalid, the rest remains in force.
